Supreme Court Hears Case That Could Gut Birthright Citizenship for Millions

Washington, D.C. – Today, the U.S. Supreme Court hears arguments in a landmark case challenging the injunction against Donald Trump’s executive order to end birthright citizenship for the U.S.-born children of noncitizen parents. The case, Trump v. CASA, threatens to unravel a core promise of the 14th Amendment and create an underclass of stateless individuals.

Trump’s executive order, issued on his first day back in office, denies citizenship to children born in the U.S. unless one parent is a citizen or lawful permanent resident. Every federal court to consider the order has struck it down as unconstitutional. Instead of defending the order on its legal merits, the Trump administration is asking the Supreme Court to eliminate nationwide injunctions—one of the judiciary’s most powerful tools for halting unconstitutional policies before they cause widespread harm.

This case isn’t just about legal interpretation—it’s about whether our country becomes one that denies children their rights based on who their parents are. That’s not just unconstitutional. It’s authoritarian. And it’s a deliberate attempt to create a permanent underclass.

This case could gut the 14th Amendment, separate millions of families, and set a precedent that threatens all Americans’ rights. We support CASA and all other advocates urging the Court to reject this order and reaffirm that in America, your rights aren’t determined by bloodline.”
